Terms of Service

Unless otherwise indicated, the Services and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Services (collectively, the "Content") and the logos contained therein are owned or controlled by us or licensed to us, and are protected by copyright laws and various other intellectual property rights.

You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Services solely for your internal business operations during the term of your active subscription.

You retain all rights to the restaurant-specific content you upload, including menu items, pricing information, and branding. By uploading this content, you grant ThinkAI Systems a worldwide, royalty-free license to host, store, and display this content specifically to provide the services to you and your diners. You represent and warrant that you own or have the necessary licenses for all content you upload.

All registration information you submit will be true, accurate, current, and complete. You agree to maintain the accuracy of such information and promptly update such registration information as necessary. If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Services.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. ThinkAI Systems will not be liable for any loss or damage arising from your failure to comply with this security obligation.

Services are available on a subscription basis. You will be billed in advance on a recurring and periodic basis (monthly or annually). At the end of each Billing Cycle, your subscription will automatically renew under the exact same conditions unless you cancel it or ThinkAI Systems cancels it. You may cancel your subscription renewal either through your online account management page or by contacting our support team.

ThinkAI Systems, in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle. We will provide you with reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.

You agree not to attempt to bypass any measures of the Services designed to prevent or restrict access to the Services, or any portion of the Services. Reverse engineering, decompiling, or disassembling any of the platform's proprietary code is strictly prohibited.

You may not use the platform to host content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, or otherwise objectionable. We reserve the right to remove any content that violates these standards.

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF.

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL ALWAYS BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.
